Agreement to Terms
By accessing or using the Clarity OS website and services ("Services"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use our Services. These Terms constitute a legally binding agreement between you and Clarity OS ("we," "our," or "us").
Description of Services
Clarity OS provides AI-powered tools designed to help individuals process thoughts, sharpen focus, and make confident decisions. Our Services are currently in development, and access may be limited to waitlist participants and beta users. Features, functionality, and availability may change without notice as we continue to build and improve.
Eligibility
You must be at least 16 years of age to use our Services. By using our Services, you represent and warrant that you meet this age requirement and have the legal capacity to enter into these Terms.
User Accounts
When we launch account-based features, you may be required to create an account. You are responsible for:
- Maintaining the confidentiality of your account credentials
- All activities that occur under your account
- Notifying us immediately of any unauthorized use of your account
Acceptable Use
You agree not to use our Services to:
- Violate any applicable laws or regulations
- Infringe upon the rights of others
- Transmit harmful, offensive, or misleading content
- Attempt to gain unauthorized access to our systems or other users' accounts
- Interfere with or disrupt the integrity or performance of the Services
- Use the Services for any commercial purpose without our prior written consent
- Reverse engineer, decompile, or disassemble any part of the Services
Intellectual Property
All content, features, and functionality of the Services — including but not limited to text, graphics, logos, design, software, and AI models — are owned by Clarity OS and are protected by intellectual property laws. You may not reproduce, distribute, modify, or create derivative works from any part of our Services without our express written permission.
User Content
Any content you submit through our Services (such as journal entries, reflections, or feedback) remains yours. By submitting content, you grant us a limited, non-exclusive license to use it solely for the purpose of providing and improving our Services. We will not share your personal content with third parties except as described in our Privacy Policy.
Disclaimer of Warranties
Our Services are provided "as is" and "as available" without warranties of any kind, either express or implied. We do not warrant that the Services will be uninterrupted, error-free, or secure. Clarity OS is not a substitute for professional mental health care, therapy, or medical advice. If you are experiencing a mental health crisis, please contact a qualified professional or emergency services.
Limitation of Liability
To the fullest extent permitted by law, Clarity OS shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Services. Our total liability for any claim related to the Services shall not exceed the amount you paid us (if any) in the twelve months preceding the claim.
Modifications to Services and Terms
We reserve the right to modify, suspend, or discontinue any part of the Services at any time. We may also update these Terms from time to time. When we make material changes, we will update the "Last updated" date and, where appropriate, notify you via email or through the Services. Your continued use of the Services after changes take effect constitutes acceptance of the revised Terms.
Termination
We may suspend or terminate your access to the Services at our discretion, without notice, if you violate these Terms or for any other reason we deem necessary. Upon termination, your right to use the Services ceases immediately. Provisions that by their nature should survive termination (such as intellectual property, limitation of liability, and dispute resolution) will remain in effect.
Governing Law
These Terms are governed by and construed in accordance with the laws of Malaysia. Any disputes arising from these Terms or the Services shall be subject to the exclusive jurisdiction of the courts of Malaysia.
